The ranchers who have taken over Federal property are upset because they believe the property is theirs. They appear to be in a no-win situation because, if their logic applies, then a much stronger case can be made by the people who inhabited the land prior to the ranchers. The people who were here before the Europeans arrived can make the claim that the land is theirs. Even within the context of US sovereignty, treaties and agreements may reinforce their position, and will predate some of the ranchers’ claims. The ranchers may unwittingly have provided the best legal defense for the tribes.
